These Terms govern your use of the website and services of The Appiksha Jain

By accessing this website, you agree to these Terms.

  1. Eligibility

You must be at least 18 years old to engage in services.

By purchasing, you confirm:

  • You have legal capacity
  • You are not under coercion
  • You understand coaching is voluntary

    2. Services Overview

Services may include:

  • One-on-one executive coaching
  • Group programs
  • Corporate workshops
  • Retreats
  • Digital courses
  • Diagnostic assessments
  • Public speaking engagements

All services are subject to separate agreements where applicable.

  1. Payment Terms
  • All fees are listed in CAD unless stated otherwise
  • Payment plans must be honored in full
  • Late or missed payments may result in suspension of access
  • No chargebacks without written dispute process

You agree to complete payment regardless of participation level.

  1. Refund Policy

Unless otherwise stated in writing:

  • Coaching services are non-refundable
  • Digital products are non-refundable
  • Retreat deposits are non-refundable

Exceptions may be granted at Company discretion.

  1. Confidentiality

The Company agrees to maintain confidentiality of client information except:

  • Where required by law
  • If there is risk of harm to self or others
  • If information is publicly shared by client

Group coaching does not guarantee confidentiality from other participants.

  1. Recording Policy

Sessions may be recorded for:

  • Training
  • Quality assurance
  • Insurance purposes

By participating, you consent to recording unless otherwise agreed in writing.

Recordings remain property of the Company.

  1. Code of Conduct

Clients agree:

  • To engage respectfully
  • Not to disrupt group environments
  • Not to solicit other participants

Violation may result in removal without refund.

  1. Force Majeure

The Company is not liable for failure to perform due to:

  • Natural disasters
  • Government restrictions
  • Illness
  • Platform outages
  • Events beyond reasonable control
  1. Governing Law

These Terms are governed by the laws of:

Province of Ontario, Canada.

Any disputes shall be resolved in Ontario courts.

  1. Dispute Resolution

Prior to legal proceedings, parties agree to attempt:

  1. Good faith negotiation
  2. Mediation

Arbitration may be required if specified in client agreement.

  1. Indemnification

You agree to indemnify and hold harmless The Appiksha Jain from any claims arising from:

  • Your actions
  • Your use of materials
  • Breach of these Terms
  1. Modifications

The Company may update these Terms at any time. Continued use constitutes acceptance.

  1. Professional Capacity Clarification

The Founder of The Appiksha Jain holds professional accounting credentials, including CPA designations. However:

  • All coaching, mentoring, leadership development, and transformational services provided through this website are delivered strictly in a coaching capacity.
  • No services shall be construed as accounting, tax, audit, assurance, legal, financial advisory, or fiduciary services unless provided under a separate written professional engagement agreement.
  • No client relationship of accountant-client, lawyer-client, therapist-client, or fiduciary nature is created by engaging in coaching services.

Clients acknowledge they are not relying on the Company for regulated professional advice unless expressly contracted in writing under a separate agreement.

  1. Transformational and Psychological Modalities Disclosure

The Company may incorporate methodologies including, but not limited to:

  • Neuro-Linguistic Programming (NLP)
  • Guided visualization
  • Cognitive reframing
  • Leadership mindset tools
  • Reflective inquiry techniques
  • Somatic awareness practices

Client acknowledges:

  • These methods are educational and developmental in nature.
  • They are not psychotherapy or licensed mental health treatment.
  • Emotional discomfort, insight, or personal shifts may occur.
  • Participation is voluntary.

Client assumes full responsibility for participation and outcomes.

If at any time Client experiences distress beyond their capacity, they agree to pause participation and seek

licensed medical or psychological support.

  1. Assumption of Risk

Client understands that:

  • Coaching may involve discussing career dissatisfaction, burnout, trauma history, leadership stress, or relational patterns.
  • Insight may alter career decisions, relationships, or professional direction.
  • Decisions made during or after coaching may impact employment, income, or business operations.

Client accepts full responsibility for all decisions and consequences arising from coaching engagement.

  1. Corporate Client Clarification

When services are purchased by a corporation or employer:

  • The contracting party is the corporate entity unless otherwise specified.
  • Confidentiality will be maintained except where:
    • Aggregate progress reporting is contractually required.
    • Ethical or legal obligations necessitate disclosure.
  • Individual coaching content will not be disclosed without written consent, except where required by law.

The Company is not responsible for internal corporate decisions based on coaching outcomes.

  1. Retreat & In-Person Event Liability Waiver

For retreats, workshops, and in-person events:

Participant acknowledges and agrees:

  • Attendance is voluntary.
  • Physical movement, travel, group exercises, or venue participation carries inherent risk.
  • Participant is responsible for personal health conditions.
  • Participant releases The Appiksha Jain from liability for injury, illness, loss, theft, or damages arising from attendance, except in cases of gross negligence.

Travel, accommodation, and third-party vendors are not under Company control.

  1. No Employment or Promotion Guarantee

The Company does not guarantee:

  • Employment retention
  • Promotion
  • Increased compensation
  • Board appointments
  • Business profitability

Leadership development is influenced by market forces, organizational dynamics, and individual execution beyond the Company’s control.

  1. Digital Platform & Data Storage Disclaimer

The Company uses encrypted third-party platforms for communication and storage.

While reasonable security measures are taken, no digital transmission is guaranteed 100% secure.

By participating, Client acknowledges inherent digital risks.

  1. Media Release – Use of Testimonials)

Client grants permission for anonymized testimonials or feedback to be used for marketing purposes unless explicitly withdrawn in writing.

Identifying information will not be shared without written consent.
